When a patient gets admitted to a hospital, all charges—like treatments, surgeries, tests, medicines, implants, drips, or even food—are completely GST-free, whether billed as a package or separately. ✅
Reason? GST Notification No. 12/2017 (Entry 74) fully exempts "healthcare services."
⚠️ But here's the confusion:
When someone visits a hospital without being admitted (for dialysis, chemotherapy, minor surgeries, dressing, or emergency-room care), the bill often includes GST charges on medicines, syringes, IV fluids, or gloves. Hospitals usually justify this saying, "You could have bought these items from any pharmacy outside, so they're not part of our healthcare service."
📢 What does the law actually say?
Our GST Research Team explored this and found a clear explanation in a recent ruling by Kerala AAR (Believers Church India, dated 02/04/2025):
✅ If medicines, drips, injections, gloves, and other medical supplies are fully consumed inside the hospital during outpatient treatments (like dialysis or chemotherapy), they're considered a part of healthcare service ("Composite Supply"), and no GST should be charged.
✅ But if the doctor prescribes medicines for you to take home, and you buy these from the hospital pharmacy, GST will apply, as this becomes a retail sale.
📌 Real-life examples to simplify this:
1️⃣ Mohan visits the hospital weekly for dialysis. The injections, tubing, saline—all are used and finished within the hospital itself. No GST. ✅
2️⃣ Ramesh had a minor injury. The doctor prescribed antibiotic tablets and ointments to take home. He bought these from the hospital pharmacy. GST applies ✅ (since it’s considered a retail sale).
⚠️ Another key point to remember: Hospital rooms (excluding ICU/CCU/ICCU / NICU) that cost more than ₹5,000 per day attract 5% GST on room rent. ICU rooms are always GST-free. Additionally, ambulance charges have no GST.
