GST DOST's NEWS
Kolkata, November 13, 2023:
In light of the recent GSTN Advisory dated November 10, 2023, the Government has extended a beacon of hope to GST taxpayers through a newly introduced amnesty scheme. This initiative is designed to aid taxpayers by offering them a chance to file appeals against demand orders issued on or before March 31, 2023, which they may have missed due to various reasons. While this presents a significant relief, tax experts urge a cautious approach and strict compliance with the scheme's guidelines.
Tax Samachar, a leading authority on tax news and advisories, brings attention to the insights of CA Vikash Dhanania from GST DOST, who underscores the importance of diligently following the advisory's directives. "This amnesty scheme is a welcome move by the government, but it should not be mistaken for an unconditional pardon. It is imperative that taxpayers understand the nuances and fulfil the criteria laid out," he states.
The GSTN Advisory sheds light on several critical points to be considered:
1. File Timely: The window for appeal submissions is narrow, closing on January 31, 2024. Taxpayers are encouraged to act without delay to avail themselves of this opportunity.
2. Pre-Deposit Requirement: In accordance with Notification No. 53/2023, it is mandatory for taxpayers to make pre-deposit payments. This is a condition that must be satisfied for the appeal to be processed.
3. Scope of the Scheme: The amnesty scheme is applicable to demand orders framed under Sections 73 and 74 of the CGST Act. This includes instances where appeals could not be filed within the original deadline and were thus rejected.
4. Strict Adherence to Guidelines: An appeal under the amnesty scheme will be considered valid only when all the stipulated conditions are met, including the necessary payments and the timely submission of appeals.
CA Dhanania advises taxpayers to meticulously check their eligibility and ensure compliance with all the requirements before proceeding with their appeal. "This amnesty scheme is a one-time window that should not be missed due to any oversight or non-compliance," he warns.

Tax Samachar stresses the importance of this GST Amnesty Scheme as a valuable chance for taxpayers to rectify their compliance status. However, it also reminds them to pay careful attention to the advisory, follow the prescribed guidelines strictly, and make the most of this beneficial provision.
