We would like to inform you that in the case of M/s Govind Enterprise, the Honourable Supreme Court has held that GST and Indian Penal Code are distinct laws from each other. So both departments, as well as Police, have the right to proceed with the investigation in case of GST evasion. However, a person cannot be punished twice under two different laws for a similar offence.
Based on the above and our experience, to avoid tension, monetary and reputation losss, it is advised that the instructions of the officer should be followed completely in case of GST enquiry. Further, an every effort should be made to provide the requested information and documents, within the specified time as directed by the GST Officer.
